Litigation Budget Template: Track Legal Fees Against a Plan

Most business owners find out what a lawsuit costs when the invoices arrive. A litigation budget turns that around: you agree a budget for each phase with your lawyer, log every invoice against it, and see overruns while you can still do something about them.

The column that changes behavior is the category. Tag the hours on each invoice as judgment work (strategy, negotiation, drafting, court) or reconstruction work (reviewing your documents, building timelines, re-explaining history). Reconstruction is the part an organized client can shrink.

Ask your lawyer before pasting case documents into any AI tool, and check every row against the source. How to use legal AI safely.

Below is a legal invoice for my own records. For each line item, give: Date | Hours | Amount | What the work was | Category (judgment = strategy, negotiation, drafting, court; reconstruction = reviewing my documents, building timelines, fact-gathering, re-explaining history; administrative). Then total each category. Don't judge whether the fees are reasonable.

Tips

  • Ask your lawyer for a phase budget in writing. It's a normal request.
  • If reconstruction stays a large share after you've handed over an organized record, ask about it directly.
  • Fee arrangements differ (hourly, flat per phase, capped, contingency); budget the way your agreement works.
  • Batch questions into one prepared call; scattered emails add up.

Frequently asked questions

How much does a business lawsuit cost?
It varies widely by case, location and how far it goes. Business lawsuits that reach discovery commonly cost tens of thousands of dollars, and trials far more. Ask your lawyer for an estimate by phase.
Can I ask my lawyer for a budget?
Yes. Asking for a written budget or estimate for each phase is a normal request and helps you track spending as the case moves.
